Disclaimer
The standard sets minimum criteria. It does not guarantee that the system meets its mission or that no harm will occur, and it does not replace legal or ethical duties.
What clause 1.9 asks
The document offers a floor, not a guarantee. A team that follows it has not proved that the system will meet its mission, and has not removed the chance of harm such as a death, a failed mission, a safety or security loss, or a financial or social loss. A declaration of conformance does not cancel anyone's duties under law, ethics, morals or finance.
Why it matters
The disclaimer is the honest limit of the product. A bias process can reduce a risk; it cannot promise that a complex system will be safe, lawful or effective. Keeping that distinction visible protects the organization when an adverse event occurs, and it protects the reader from treating a conformance claim as a guarantee.
What good looks like
Put the disclaimer in the assurance pack, not only in the standard's front matter. Pair it with the organization's own risk acceptance and legal review. Train the team to say what the process does and does not prove. When a customer asks for a guarantee, offer the evidence and the limits rather than an assurance the standard does not give.
Evidence an assessor asks for
The assessor will check that the claim and the disclaimer travel together. A pack that leads with conformance and hides the limitation is misleading even if every clause is met.
- Disclaimer in pack The limitation paragraph in the assurance response, beside the claim
- Risk acceptance The signed acceptance of the residual risk that remains after the controls
- Legal review The record that legal and ethical duties were considered separately from conformance
- Incident route The process for an adverse event, including who is told and when
Where it commonly fails
- The claim is presented as a guarantee that the system is unbiased
- The disclaimer is in the standard but not in the customer pack
- Conformance is used as a defence in a legal dispute
What to do before publication
Add the disclaimer to the claim template now. Then agree the risk acceptance and the incident route, so the limitation is backed by a real process.
